Judge dismisses case against fascist leader sued for mocking teacher beaten by 150 students | News from the Valencian Community

A court in Llíria (Valencia) has filed a case against the leader of the Valencian fascist party España 2000, José Luis Roberto, who was reported for an alleged hate crime for having mocked a homophobic attack against a teacher beaten by 150 students in 2022 while shouting “faggots”, according to a court order to which EL PAÍS had access.

Roberto, a lawyer and private security entrepreneur, admits having defined Miquel Álvarez, who in 2022 was a physics and chemistry teacher at the Les Alfábegues de Bétera high school (Valencia), which welcomes more than 1,000 students, as a “little mermaid” on social media. The teacher later reported that 150 young people attacked him, shouting “you shouldn’t live in Spain” and calling him a “faggot”. The pack also threw objects at him and pulled his hair. The origin of the anger lies in the removal of a Spanish flag that the students displayed in response to another LGTBI that other students at the center had displayed the day before to record a video. The incident resulted in the expulsion of a dozen students.

The judge does not consider whether the fascist leader’s social media messages constitute a hate crime, punishable by one to four years in prison. The investigating judge temporarily archives the case due to a formal flaw: the suspect’s statement was drawn up after the legal deadline for the investigations expired, which ended in April 2023. “Once the maximum investigation period (12 months) has expired without a valid extension having been agreed upon and it being legally impossible to carry out a new proceeding, the proceeding cannot evolve towards an order for transformation into an abbreviated procedure, as there are no valid actions that allow an accusation to be supported”, establishes the teacher Gema. At 71, Roberto is an old acquaintance of the Valencian far right. A former professor, former general secretary of the Anela brothel association and creator of a private security emporium that employs 1,000 workers, the leader has attracted controversy for decades. This newspaper revealed that the ultras have been organizing the “War in the Streets” self-defense seminar since 2021. These are MMA training sessions – a combination of martial arts and fighting techniques – in which members of the state and army security forces and bodies participated in three editions.

Admirer of the great man of national fascism Ramiro Ledesma Ramos, founder of the National Union Offensive Boards (JONS), the first of Roberto’s puddles dates back to the Transition. The politician was arrested in 1976 on charges of having planted bombs in the Levante UD stadium during a concert for independence. The case did not go to court.

Based in Valencia, Spagna 2000 is not represented. In 2015 he obtained six councilors in four municipalities of the Corredor de Henares of Madrid. Last May, a Madrid court closed an investigation against Roberto and former Ultra Sur leader Alberto Ayala de Cantalicio for promoting a neo-Nazi march that toured the Madrid neighborhood of Chueca in September 2021, a meeting point of the LGTBI collective, shouting “fags out of our neighborhoods” and “fags out of Madrid”as this newspaper revealed.
