After partial legalization: Mixing alcohol and marijuana while driving: Federal Council wants review

The Federal Council calls on the federal government to limit the consumption of mixed alcohol and marijuana to check whether it is dangerous in road traffic even below the existing limit values. The state chamber voted in Berlin for similar initiatives from Brandenburg and Thuringia.

«The problem of mixed consumption alcohol and marijuana has not been adequately regulated. “Anyone who smokes while drinking beer and then sits in a car is negligent,” said Brandenburg Transport Minister Detlef Tabbert (BSW). Mixed consumption of alcohol and cannabis reduces roadworthiness and endangers road safety, according to Thuringia’s Minister of Digital and Infrastructure, Steffen Schütz (BSW).

No tolerance required

So far, except for novice drivers, it is not prohibited to consume small amounts of marijuana and alcohol simultaneously on the road, as long as it is still below the limit value. According to the law, consuming alcoholic beverages is only a misdemeanor if you have a concentration of 3.5 nanograms of THC (tetrahydrocannabinol) or more per milliliter of blood while driving. Brandenburg and Thuringia wants zero-tolerance regulations for all drivers – namely a fundamental ban on the simultaneous consumption of cannabis and alcohol.

Alcohol-cannabis mixtures should be tested for their effects

With incoming resolution Federal Council The federal government was asked to review the current THC limit of 3.5 nanograms in light of the crash. It is also necessary to clarify the extent to which mixed consumption with alcohol causes dangerous interactions, even below the current standard limits. Marijuana was partially legalized on April 1, 2024.
