This Monday, the State Attorney General asked the Minister of Industry, Félix Bolaños, to be dismissed by the Council of Ministers. Álvaro García Ortiz decided to resign after the Supreme Court sentenced him to a two-year ban from office for the crime of revealing secrets and imposed a fine of 7,200 euros and the payment of compensation of 10,000 euros to the entrepreneur Alberto González Amador, partner of Isabel Díaz Ayuso and tried for tax fraud. García Ortiz will not wait for the Supreme Court to carry out the sentence, which has not yet been written.

This is the full text of the letter, dated Monday 24 November:

“Dear Minister:

On November 20, I was notified in advance of the sentence pronounced at the end of the oral trial held before the Criminal Section of the Supreme Court (special case 20557/2024).

This judicial decision, before any other consideration, implies that the highest court of ordinary jurisdiction in our country has agreed to inflict on me the penalty of special disqualification from the office of Attorney General of the State, after evaluating the facts which are the subject of criminal proceedings as criminal, in the absence of greater specificity.

The profound respect for judicial resolutions and the desire – always present in my mandate – to protect the Spanish Prosecutor’s Office and its prosecutors determine my decision to present, without even waiting to know the reasons for the sentence, my resignation as Attorney General. It is an act owed not only to the Public Prosecutor’s Office, but to all Spanish citizens.

Although my determination derives directly from the sentence notified to me, to my credit I am convinced that I have faithfully served the institution to which I am honored to belong, with an unequivocal vocation to public service, sense of duty and institutional loyalty.

Therefore, with this letter, in accordance with the provisions of article 31.1 a) and 3 of Law 50/1981, of 30 December, which regulates the Organic Statute of the Public Prosecutor’s Office, I ask at my request that the Council of Ministers accept the termination of my mandate as State Attorney General.

I thank the Spanish Government for the proposal that led to my appointment on 19 July 2022. The trust placed then is the same that I reciprocate now when I understand that, once failure has been known, it is time to abandon the fulfillment of such a high responsibility.

Without further ado, I take this opportunity to offer you an affectionate greeting.

Signed “Alvaro García Ortiz”
