The family of Juan Carretero, a daily worker who became quadriplegic following a car accident on a street in Seville in 2004, has reported that more than 20 years after the incident they have failed to collect the compensation ordered by the judge, which had been set at one million euros. In a statement, the family’s lawyer, Fernando Osuna, criticized the “judicial jam” of the Utrera court, since not only did they not receive the compensation of one million euros that they were entitled to as a result of the sentence, but they only managed to seize the sum of ten euros, money that the family collected in 2020.
The case dates back to February 29, 2004, when Carretero, 66 years old, originally from Algodonales (Cadiz), became quadriplegic due to a road accident when the vehicle he was traveling in collided with a mule on the road that connects Utrera with Los Palacios and Villafranca (Seville), while he was on his way to work in the province of Huelva, at 9.30 pm.
Given the delay in collecting compensation, in June 2018 Justice set the increase of the fine at 60,000 euros due to the poor functioning of the court, a sum that took a year to receive, although the main sum has not yet been collected, which could have been resolved if the Utrera Court had handled the trial normally, but traffic in this body prevented this.
The same lawyer underlined that Carretero “died frustrated after 14 years of poor functioning of the judicial body of Utrera”, to the point that “it took a year to make a report between two judicial offices separated by 30 meters”, but they received the wrong document “and the report they took came from another trial”.
The family requested the seizure of a property owned by the convicts, but their request has not yet been satisfied.
