Because of that, “any action arising from the irregular appointment of Ms Halligan”including the indictment of James Comey and Letitia James, “constitutes an abuse of executive power and is therefore void.”
Former Donald Trump adviser Lindsey Halligan was selected by Justice Secretary Pam Bondi to serve as Attorney General for the Eastern District of Virginia, after the incumbent resigned, exhausted by the pressure placed on her to speed up the initiation of prosecutions. But as defense attorneys pointed out, the 120-day deadline that interim federal prosecutors must meet to be confirmed by the Senate or approved by a district judge had already passed when these attorneys took office.
At this time, the withdrawal of Halligan’s nomination is without prejudice, meaning the charges against Comey and James could be reintroduced. This is primarily based on his appearance before the US Senate in September 2020, where he testified about the federal police investigation into alleged ties between Russia and the Republican Party’s winning campaign in 2016.
