Justice against Donald Trump, new episode. Federal Judge Cameron McGowan Currie decided on Monday, November 24, to dismiss the indictment of former FBI Director James Comey and New York Attorney General Letitia James, and ruled that the appointment of Lindsey Halligan, the prosecutor behind the decision, was invalid.

“The Attorney General’s attempt to appoint Ms. Halligan as acting federal prosecutor for the Eastern District of Virginia is unlawful,” he wrote in his order, reported by CNN. Because of that, “any action arising from the irregular appointment of Ms Halligan”including the indictment of James Comey and Letitia James, “constitutes an abuse of executive power and is therefore void.”

Former Donald Trump adviser Lindsey Halligan was selected by Justice Secretary Pam Bondi to serve as Attorney General for the Eastern District of Virginia, after the incumbent resigned, exhausted by the pressure placed on her to speed up the initiation of prosecutions. But as defense attorneys pointed out, the 120-day deadline that interim federal prosecutors must meet to be confirmed by the Senate or approved by a district judge had already passed when these attorneys took office.

At this time, the withdrawal of Halligan’s nomination is without prejudice, meaning the charges against Comey and James could be reintroduced. The New York prosecutor, a Democrat and behind the state’s prosecution of Donald Trump and his two sons, Donald Jr. and Eric, has been on trial since October 10 on suspicion of false statements with the intent to obtain a bank loan, at Donald Trump’s express request.

James Comey also became the target of a Trumpian firestorm. The former FBI director, who was fired in May 2017 and indicted in September 2025, was charged with obstructing a parliamentary investigative commission and making false statements to Congress, two convictions that carry up to five years in prison. This is primarily based on his appearance before the US Senate in September 2020, where he testified about the federal police investigation into alleged ties between Russia and the Republican Party’s winning campaign in 2016.
