Deputy prosecutor Eugenio Fusco and prosecutor Cristian Barilli asked for a sentence of one year and 8 months Chiara Ferragni accused, along with two others, in a trial in Milan with a shortened trial of aggravated fraud in high-profile cases regarding alleged misleading advertisements for Pandoro Pink Christmas and Easter eggs. According to prosecutors, in the investigation of the Gdf Economic and Financial Police Unit, between 2021 and 2022, he defrauded followers and consumers with alleged unfair profits – in connection with the sale of the two products, the price of which did not include the advertised charity – of around 2.2 million euros. The influencer has always denied the allegations and his defense will intervene at the next trial.

Operation Balocco

According to the prosecutor’s office, the influencer deceived consumers and obtained, through two commercial campaigns, unfair profits of around 2.2 million euros, as well as unquantifiable profits “from profit on image”.

In particular, the ‘Balocco’ operation allegedly misled “an unspecified number of buyers” who believed that with their purchase of Pink (at a price of 9.37 euros, instead of 3.68 euros for the traditional product) they would finance a fundraiser for the Regina Margherita hospital in Turin. However, the agreement turned out to be different, according to the prosecutor’s office: Ferragni’s company collected more than one million euros to advertise via Instagram a charity initiative of which Balocco’s company had allocated 50 thousand euros to the hospital, regardless of sales. The alleged “communication error” also occurred in the second disputed case.
