“Losses of more than 7 million hidden”

Process risks for former Cinecittà spa CEO Nicola Maccanico accused of false corporate communications as part of investigation by Rome prosecutor’s office. Capitoline prosecutors in the notice of the conclusion of the investigation, which usually precedes the request for a trial, accused Maccanico in his capacity as managing director while competing with Claudio Ranocchi as manager in charge of drawing up Cinecittà spa’s accounting documents of having “deliberately” disclosed in the company’s financial statements of December 31, 2022 “relevant material facts that do not correspond to the truth, in a manner concretely suited to mislead others”. In particular, according to the allegations formulated by prosecutors at the Rome prosecutor’s office following an investigation by the Guardia di Finanza, Maccanico and Ranocchi “displayed unearned income of approximately 2.4 million euros in the profit and loss statement, on the one hand by recording actual income of 1,758,000 euros relating to 2023 and on the other hand by failing to record the amount of 662,000 euros of credit notes as a deduction relating to 2022; as a result, they showed a profit of 1,838,074 euros that was never achieved, hiding an actual loss of more than 500 thousand euros”.

The two suspects were charged in the same case, in an investigation carried out by prosecutor Giorgio Orano coordinated by deputy prosecutor Giuseppe Cascini, also over the company’s financial statements as of December 31, 2023. In this case, according to the prosecutor “they showed unearned income of 2,471,398 euros in the profit and loss statement by omitting the accounting of the credit note issued to Freemantle Italy Group srl for the amount recorded in 2024 but referring to 2023 (which relates to the discounted turnover expected by Cinecittà Spa in 2023)”. Furthermore, “they indicated in the profit and loss statement that the costs were 5,542,280 euros lower than those actually incurred for the creation of the set (based on a procurement contract with The Apartment srl, and therefore the set owned by the client, relating to the production of the films ‘M. As a result, according to the allegations, “they showed on the balance sheet a profit of 1,300,614 euros that was never realized, hiding an actual realized loss of about 6.7 million euros”.
