The Cassation Court opened the field for group lawsuits

Will we see class action related to discrimination in the workplace increase? On Wednesday, November 5, the Court of Cassation issued a clear opinion opening up the scope of the procedures imposed by law to modernize the judiciary in the 21st century.e century 2016.

The social chamber of the high court overturned the decision of the Paris Court of Appeal that dismissed the class action filed by CGT against Safran Aircraft Engines, considering that the judge should not have ignored the facts of trade union discrimination before 2016 because the action continued to have effects after that date.

The case occurred in 2017, when the CGT Metallurgical Workers’ Federation notified Safran of its intention to initiate group action. The union then accused the company of structural discrimination against its elected officials: limited career development, hampered remuneration, slowed hierarchical advancement, etc. The federation took legal action in 2018, with support from the confederation. On this occasion, Human Rights Defenders conveyed their observations in which the institution noted the existence of discrimination “systemic and collective”.
