The head of the Investigative Court Number 1 of Almería, which is investigating the alleged bites in the case of the masks of the Provincial Council of Almería, sees “very clear and solid indications” of the possible participation of the former president of that body, Javier Aureliano García, and his former number two, Fernando Giménes, in the “collection or facilitation of the collection of commissions”, according to the order issued last Tuesday and which led to the arrest of both former leaders of the PP. The magistrate underlines “the important role” that García had in the “criminal network” and to justify his reasoning he makes use of the “encrypted terminology” that both supported together with another of the suspects in the conspiracy, the former third vice-president of the institution, Óscar Liria, in a joint chat, in the days preceding the signing of the alleged scam for the assignment of medical supplies worth two million euros and the management of the cash of the former president of the PP. from Almería to pay the mortgage installments or trips taken in Liria’s company.

The judge’s first indications are found in the conversations that García, Giménez and Liria have in a joint chat, called Naranjito and in which, since at least 2017, they have been using “an encrypted or coded language” and which “are repeated on dates very close” to the signing of the contract on masks which started the investigations, on 8 April 2020, in full confinement. In that chat, reference was made to typical terminology in the field of dentistry: “I have to go to the dentist and I don’t know when to go… I also have to do a cleaning”; “This afternoon I made an appointment for a cleaning”; “You owe me money… I need to get two or three teeth filled, make a dentist appointment next week because I can’t eat”; “you can change the entire piñata”…

For the teacher it is “very surprising that terms related to orthodontics are used in a context completely unrelated to the previous one, since the rest of the conversation deals with ongoing public tenders”. The judge also believes that the use of these terms occurs “in an absurd, insulting and often inexplicable way”, which leads him to deduce that they refer to this dental terminology “when in reality we are talking about public tenders and the awarding of various public contracts”. “The above constitutes a very clear and very solid indication of the possible participation of Mr. Fernando and Mr. Javier Aureliano in the collection or facilitation of the collection of commissions.”

One of those oral messages, signed with the “emoticon of a tooth or a molar” by the then president of the Provincial Council, was sent at 8.53pm. on April 8, 2020, three minutes after the signing of the decree of the public contract for the assignment of medical supplies, a “devastating” sign, according to the ordinance, which “symbolizes the importance of the role that Don Javier Aureliano played in the criminal sphere”. Other evidence relevant to the instructor is García’s “excessive interest, concern and nervousness” in concluding that judgment. “And ours? I’m very nervous”, he asks Liria after an “incessant exchange of messages” on the operation carried out with Kilian López, owner of the winning company, Azor Corporate, and childhood friend of the former number three of the provincial council.
