A woman who prosecutors believe killed eight-year-old Fabian has been detained for two and a half weeks. Now his lawyer has contacted him.

The lawyer for the suspect in the Fabian case who was arrested wants his client to be released from detention. “On my part, a habeas corpus application has been filed,” lawyer Andreas Ohm told the German Press Agency on Monday.

“Nordkurier” had previously reported on the application – and quoted Ohm as saying that he saw a realistic chance that the Rostock district court would rule in favor of his client.

So far, the prosecutor’s office has basically relied on evidence, some of which was taken out of context, the lawyer explained: “No hard evidence can be found in the file.” So far no murder weapon has been found, either on his client or anywhere else.

When asked how his client was doing, Ohm simply told “Nordkurier”: “He wants to be released from prison.” On his advice, the woman will remain silent about the allegations.

The woman was arrested on November 6 on suspicion of murder in a village near Güstrow in Mecklenburg-Western Pomerania. Eight-year-old Fabian disappeared without a trace from his mother’s apartment on October 10. Police searched for the large child for four days, then a witness reported finding the body on the edge of a pond south of Güstrow.

According to media reports, the witness is a woman who is currently being held as a suspect. She is said to be Fabian’s father’s ex-girlfriend.
