The Court of Cassation decided this after a hearing at the end of the murder trial of Willy Monteiro Duarte, the twenty-one year old man killed in a beating in Colleferro on the evening of September 6, 2020. The Judge of the Fifth Criminal Section, accepting what was requested this morning in the indictment by Deputy Attorney General Luigi Birritteri, ordered a new appeal hearing to revisit the general mitigating circumstances granted to Gabriele Bianchi, sentenced to 28 years on second appeal, instead confirmed a life sentence for his brother Marco.
At the first trial, the Bianchi brothers were sentenced to life imprisonment, while at the first appeal trial, the judge granted general mitigating circumstances, resulting in both sentences being reduced to 24 years. The Court of Cassation has recognized the criminal responsibility of all the defendants for voluntary manslaughter and determined final sentences for the other two defendants, 23 years for Francesco Belleggia and 21 years for Mario Pincarelli.
